Information to candidates pursuant to art. 13 GDPR
Pursuant to EU Regulation 2016/679 "General Data Protection Regulation" (hereinafter: "GDPR") - which guarantees that the processing of personal data is carried out in compliance with fundamental rights and freedoms, with particular reference to confidentiality and personal identity - we wish to inform you about the methods of processing your personal data and the rights you can exercise pursuant to the aforementioned legislation.

Categories of data

TechStar will process, for the purposes described below, the personal data you provide by completing the form on the TechStar website on the "Work with us" page [or other name] and / or through your application collected via email and / or received by ordinary mail. The Data includes in particular your name, contact details, your qualifications and supporting documentation. Finally, in the selection process, we may process your data legitimately obtained from public sources (e.g. professional social networks). Your particular data may also fall within these categories pursuant to art. 9 (1) GDPR (e.g. health data) which will be processed, pursuant to art. 9 (2) b) and h) GDPR, within the limits of the pertinent information only and not exceeding the purposes for which it was acquired.

Purpose of the processing and legal bases

TechStar, even with the aid of electronic or automated systems, will process your personal data for the following purposes:

in the event of an application for a specific job offer, the processing of the personal data provided by you will be aimed solely at carrying out the personnel selection process relating to the open position for which you have applied. The lawfulness of the processing, necessary and essential to carry out the selection process, derives mainly from art. 6 (1) b) GDPR in conjunction with art. 88 (1) GDPR and the General Authorization No. 1/2016 of the Guarantor for the protection of personal data (Authorization for the processing of sensitive data in employment relationships - 15 December 2016);
in the event of failure to pass the selection process following an application to a specific job offer, TechStar will have the right to use your data for your inclusion in future personnel selection processes in line with your profile. The lawfulness of the processing in this case derives from art. 6 (1) a) GDPR. In case of failure to give consent, you will still have the right to independently apply to further specific job offers published on the portal;
in the event of a spontaneous application or failure to complete the registration process on our portal, the processing of the personal data you provide will be aimed at your inclusion in future personnel selection processes in line with your profile. The lawfulness of the processing, necessary and essential to carry out the selection process, derives mainly from art. 6 (1) b) GDPR in conjunction with art. 88 (1) GDPR and the General Authorization No. 1/2016 of the Guarantor for the protection of personal data (Authorization for the processing of sensitive data in employment relationships - 15 December 2016).
We would like to inform you that, pursuant to the applicable European anti-terrorism legislation, we may have to use the personal data of candidates to carry out the necessary checks with respect to the possible presence of their names in the appropriate EU lists. In this regard, by sending your application, you also authorize the processing of your data for this purpose. The lawfulness of this treatment derives from art. 6 (1) c) GDPR.

Data recipients

Your personal data may be disclosed to the managers of the departments / sectors involved in the selection process and to the HR sector.

Data retention times

Your personal data will be processed and stored in full compliance with the principles of necessity, data minimization and limitation of the retention period, through the adoption of technical and organizational measures appropriate to the level of risk of the treatments and for a period of time not exceeding. to the time necessary to achieve the purposes for which they are processed or to that dictated by the applicable legislation.

In particular:

in case of application for a specific job offer, the personal data of the interested parties will be kept for 12 months from the date of your last application. At the end of the retention period, the personal data will be deleted or adequate measures will be taken to make them anonymous in accordance with the applicable legislation;
in case of failure to pass the selection process following an application to a specific job offer and consent to the further use of the data for inclusion in future selection processes, these will be kept for 24 months from collection of consent;
in the event of a spontaneous application or failure to complete the registration process on our portal, personal data will be kept for 24 months from the date of registration on our portal or, if later, from the last update of your profile by you. At the end of the retention period, the personal data will be deleted or adequate measures will be taken to make them anonymous in accordance with the applicable legislation.

Transfer of data outside the EU

It may be necessary to transfer your data to group companies located outside the European Economic Area (EEA) for specific purposes related to the management of the selection process. The transfer will take place only in the event that the European Commission has confirmed an appropriate level of data protection in the third country or in the presence of appropriate data protection guarantees (e.g. the standard EU contractual clauses for the transfer of data to third countries) .

Rights of the interested party

In relation to the processing of your personal data, you can exercise the following rights recognized by the GDPR at any time:

the right to obtain access to their personal data from TechStar (Article 15 of the GDPR);
the right to obtain from TechStar the rectification of inaccurate personal data and the integration of incomplete ones (Article 16 of the GDPR);
the right to obtain the cancellation of personal data, if they are no longer necessary with respect to the purposes for which they were collected and if there are no further legal storage needs (Article 17 of the GDPR);
right to request a limitation of the processing of personal data in the presence of one of the conditions listed in art. 18 GDPR, meaning that, although your data may continue to be stored, they may only be processed under limited conditions (Article 18 of the GDPR);
the right to obtain the portability of personal data, meaning that TechStar will provide you with the data in a structured, common and readable format (Article 20 of the GDPR);
right to object to the processing for reasons connected to your particular situation (Article 21 of the GDPR). TechStar will refrain from further processing your data unless it demonstrates the existence of compelling legitimate reasons to proceed with the processing (eg for the defense of your rights in court).
